This section applies only if Supreme Spirits approves and extends credit terms to the applicant.
The undersigned hereby requests an open account with Supreme Spirits and certifies that all information provided in this application is true and correct.
PERSONAL GUARANTEE
If credit terms are approved and the credit customer is a corporation, limited liability company, partnership, or other business entity, the individual signing below as Guarantor personally and unconditionally guarantees payment of all amounts owed to Supreme Spirits for products purchased on credit by the applicant.
This Personal Guarantee applies only to purchases made pursuant to credit terms approved and extended by Supreme Spirits and does not apply to transactions paid COD, prepaid, or otherwise paid in full at or before delivery.
Past-due balances will accrue a finance charge of 1.5% per month, equivalent to 18% per annum, or the maximum rate permitted by applicable law, whichever is less.
In the event collection efforts or legal action are required to collect amounts due, the applicant and Guarantor agree to pay all reasonable collection costs, court costs, and attorneys’ fees to the extent permitted by law.
The applicant authorizes Supreme Spirits to verify business and credit information supplied in this application and to obtain credit information reasonably necessary to evaluate or maintain the account.
Electronic signatures, scanned copies, and emailed copies of this application and Personal Guarantee shall have the same force and effect as an original to the extent permitted by applicable law.
